Superseded planning schemes
The Barcaldine Region Planning Scheme 2023 has effect from 14 August 2023. It replaces and supersedes the three planning schemes previously implemented for different parts of the region.
Section 29 of the Planning Act 2016, together with sections 11 and 12 of the Planning Regulation 2017, sets out the process and requirements for a person seeking to have a superseded planning scheme apply to a proposed development. A superseded planning scheme request must be made in writing to the Council within one (1) year after the planning scheme creating the superseded planning scheme took effect.
If Council approves a superseded planning scheme request, then the person has six (6) months from the date of that approval to lodge the development application to be assessed under the regime of the superseded planning scheme, rather than the more recently gazetted planning scheme. Fees may apply to the making of a superseded planning scheme request.
